Terms of Service. The deal, in plain words.

Maca, a brand of Arkode Holding Group LLC (Boulder, Colorado).
The short version
This summary helps you read. It is not the whole deal. The full terms below are what count.
- These terms are the deal between your business and Maca, a brand of Arkode Holding Group LLC.
- Maca is for US businesses. You must be 18 or older and able to sign for your business.
- Your free site is free. Our packages cost what our pricing page says, plus tax where it applies.
- You pay nothing until your phone is live. Then you pay each month, or each year.
- Not for you? Tell us within 30 days of your first payment, and we pay back your first month, or your year. Once per business.
- Month to month. Cancel any time with a text or an email.
- If you cancel, your site goes back to the free one and stays up. Your web address and your Google listing stay yours.
- Our AI answers calls. It says it is AI and that the call is recorded. It can make mistakes.
- Reply STOP to any text to stop, and HELP for help. Msg and data rates may apply.
- What we owe you if something goes wrong has a limit: what you paid us in the last 12 months.
- Colorado law applies. Cases go to the courts in Boulder County, Colorado, or to small claims court.
Who we are and what these terms cover
These Terms of Service (the “Terms”) are a binding agreement between Arkode Holding Group LLC, a Colorado limited liability company based in Boulder, Colorado, which does business as “Maca” (“Maca,” “we,” “us”), and the business that claims a free site, buys a package or uses our service (“you”).
Our service (the “Service”) is getmaca.io and its pages, the websites we build and host, our paid packages and add-ons, the AI that answers calls, the texts and emails we send for you or to you, and the work our team does for you.
Our Privacy Policy, at getmaca.io/privacy, explains how we handle personal information.
The short version at the top of this page and the section titles help you read. They are not part of the deal.
How you agree to these Terms
You agree to these Terms when you claim a free site, add a card at checkout, or use the Service, whichever comes first. If you don't agree, don't use the Service.
The person who agrees for a business says they are at least 18 and allowed to sign for that business. If they are not allowed, they agree to these Terms for themselves.
You agree that we may give you these Terms, notices and receipts by email, by text or on our site, and that agreeing online counts as your signature.
Who can use Maca
Maca is for businesses in the United States that serve customers in the United States, sole owners included. It is for business use only, not for personal, family or household use.
There is no login. Your account is the record we keep for your business. You reach your contact at Maca by text, WhatsApp or email.
We may act on instructions, like a change, a new package or a cancellation, that come from the cell number or email you gave us for your account, or from a person you tell us in writing may act for your business. Keep them safe, and tell us when they change.
Keep your contact and billing details true and up to date.
We may decline to serve any business for any lawful reason.
Free sites, and the sites we make before you ask
We may build a free website for a business from its public Google listing and other public facts, before the business asks, and email the business about it.
Anyone can take down a free site that nobody has claimed. Tap “Remove this page” at the bottom of it, then confirm on the page that opens (getmaca.io/remove). Or write to hola@getmaca.io with the page's web address. We take it down, stop emailing that business, and don't build it again.
When you claim a free site, you tell us you own the business or may act for it.
Your free site is in English and Spanish, on a getmaca.io web address, with a small “Made with Maca” line. A person checks it before it goes live. There is no charge and no card. You can email us changes when you claim it. After that, changes come with a package.
Your free site stays up as long as you want it and you follow these Terms. You can ask us to take it down any time. If we ever stop offering free sites, we tell you at least 30 days before and send you a copy of your site's words and photos.
We may take down anything on a site we host that is false, breaks the law, uses someone else's work without permission, or breaks these Terms.
Packages and add-ons
Our paid packages today are Respond, Answer and Grow. Our pricing page (getmaca.io/pricing) says what each package and add-on includes and what it costs, in US dollars. The pricing page on the day you buy is part of these Terms.
Each package includes only what its list says. Work that is not on the list is an add-on, or we quote it in writing before we start. Changes to your hours, prices, services, service area, photos, a few lines of words on your site, and what the AI says are included in every package.
Answer and Grow include a set number of call minutes each month. The pricing page shows them, with about how many calls that is. Calls differ in length, so the number of calls is a guess. We tell you when you've used 80% of your minutes, and again when you've used them all. We keep answering. Unused minutes don't carry over to the next month.
Respond does not answer calls. It texts back the people whose calls you miss.
The times we give, like an answer the same business day or a change in 2 business days, are goals we work to meet, not promises of a result. A business day is Monday to Friday, 9 AM to 5 PM US Central time.
We don't do ads, social media posts, or a live person on your phone.
Our first 10 paying clients get the extras our site lists for them. Their package price stays the same for 24 months from their first bill, even if our prices go up. The lock covers the package price only, not add-ons, extra minutes or taxes. The extras have no cash value.
To move up or down a package, text or email us. We tell you the new price first. A move up starts right away, and the difference for the rest of your billing period is charged then. A move down starts at your next bill.
Billing
You pay by card through Stripe, our payment company. Stripe keeps your card. We never see your full card number. You let us, and Stripe for us, charge your card for your package, monthly add-ons, extra minutes, one-time add-ons you ask for, and taxes, each time they are due, until your package ends.
You pay nothing until your phone is live. When you add your card, we start setting you up, for free. Your first bill is on the day your service goes live (your “go-live day”). On Answer and Grow, that is the day we start answering your calls. On Respond, it is the day we start texting back the calls you miss, after the phone companies approve your texts. Stripe's page may call the setup time a free trial.
The free setup lasts up to 60 days. If your service is not live by then, we either give you more time or end your package, and you pay nothing for the setup. If a charge ever goes through before your go-live day, we pay it back in full.
After your first bill, you pay ahead, on the same day each month. If you pay for a year, you pay for 10 months and get 12, on the same day each year.
A yearly package renews for another year on its renewal date. We email you at least 30 days before it renews, with the price and how to cancel. To stop it, tell us before the renewal date, and your package ends when the paid year ends. You can also ask to switch to monthly billing.
Extra minutes on a monthly package are billed on your next bill, at the per-minute rate on our pricing page. On a yearly package, we don't bill extra minutes. We call you to talk about your package instead.
Monthly add-ons are billed with your package. One-time add-ons are billed before we start the work. If we can't deliver a one-time add-on, for example if Google won't give back a listing, we pay it back.
Prices don't include sales tax or similar taxes. Where the law says we must collect a tax, we add it to your bill.
If a payment fails, we tell you, and your service keeps running while Stripe tries again for about 2 weeks. If the last try fails, your package ends, and the section on canceling says what happens next. We don't charge late fees or interest, and we don't send unpaid bills to a collection agency. If you come back later, we may ask you to pay what was left first.
If we raise the price of your package or a monthly add-on, we tell you by email, and by text if you said yes to texts, at least 30 days before. The new price starts at your first bill after those 30 days. If you don't want it, you can cancel before then.
If a charge looks wrong, please tell us within 60 days. We answer within 5 business days, and we fix our mistakes in full. You can still dispute a charge with your bank. While a bank dispute is open, we may pause paid work covered by that charge.
Our promise: your first month back
If Maca is not for you, tell us by text or email within 30 days after your first payment. We pay back what you paid for your package: your first month, or your whole year if you paid for a year. You don't need to give a reason.
Extra minutes and add-ons are not paid back. Tax on the amount we pay back is paid back with it.
This promise is once per business, even under a new name, owner, card or phone number.
When we pay you back, your package ends that day. Your site goes back to the free one and stays up. Your web address and your Google listing stay yours. The section on canceling says what else happens.
We pay back to the card you paid with, through Stripe. We start it within 5 business days of your ask. Your bank usually shows it 5 to 10 business days later.
After those 30 days, we don't pay back time you already paid for, except for our billing mistakes, when we end a package without cause (see “When we can pause or end service”), or where the law says we must. This promise adds to any right the law gives you.
Canceling, and what happens after
You can cancel any time. Text, email or WhatsApp your contact at Maca, or email hola@getmaca.io. We confirm by text or email. You don't need to call us.
Your package ends at the end of the month, or year, you already paid for. We don't charge you again for it. If you cancel before your go-live day, it ends right away and you pay nothing.
Canceling doesn't erase what you already owe, like extra minutes used before your package ended.
When a package ends, for any reason:
- Your site goes back to the free one, on a getmaca.io web address, and stays up.
- Your web address stays in your name. We paid for it while you were a client. From then on, you renew it yourself. We give you the login when you ask.
- Your Google listing stays yours. You stay its main owner, and we remove our access when you ask.
- We stop answering and texting for you, asking for reviews, posting, and sending reports.
- For 60 days, calls that still reach your Maca number go straight to your cell, with no AI and no texts. Turn off the setting that sends your calls to us, and we tell you how. After those 60 days, that number stops passing your calls to you.
Your part
Give us true, full and current information: your services, prices, hours, service area, what counts as urgent, the cell for urgent calls, and, to register your texts, your legal business name, address, tax ID number (EIN) and a contact. Tell us when it changes. Our AI only knows what you tell us. We are not responsible for mistakes that come from information you gave us or didn't update.
Your callers and customers deal with your business. You are responsible for your business's duties to them under the law, including any notice about how your business uses their information, and the rules on prices, ads and your trade.
You are responsible for your licenses, permits and insurance, your prices and estimates, your work, and what you promise your customers. We don't check your licenses or insurance.
Give us only phone numbers you are allowed to text, for the reason you give them to us.
Keep your cell on for the urgent calls we send you. Read the texts and emails we send you, and call your customers back.
You keep your own phone service and business number, and you pay your phone company. You turn on, and later turn off, the setting that sends your calls to us.
Book and join your setup call, and answer our setup questions. If that takes longer, your go-live day may move.
You are responsible for anyone who uses the Service for your business.
What you let us do for you
Depending on your package, you let us act for your business, only to:
- answer your calls and text your callers in your business's name;
- register your business's texts with the phone companies and The Campaign Registry, through our Twilio account, with the legal name, EIN, address and contact you give us;
- manage your Google listing as a manager: edit it, post on it and reply to its reviews;
- register a web address in your name, or connect one you already have;
- ask each customer you served for a Google review; and
- set up, in your name, other listings or services named on your package's list.
Google, Stripe, WhatsApp, the phone companies, The Campaign Registry and the company that registers web addresses have their own rules. We follow them when we act for you, and you must follow them too. If their rules change, what we can do for you may change.
The AI that answers your calls
On Answer and Grow, AI answers the calls that reach your Maca number, in your business's name, in English and Spanish. In its first sentence it says it is an AI assistant, and that the call is recorded and may be shared with the companies that run our AI. It never says it is a person.
Every call we answer is recorded and written down. You agree to this for your line, including after the AI passes a call to you and you join it.
It can make mistakes. It can mishear a name, a number or an address, give wrong information, book the wrong time, miss or drop a call, or fail to reach your cell. Phone lines and the companies we use can go down.
It gives only the prices you gave us, and offers only the times you told us are open. It texts you each booking. It doesn't put jobs in your calendar. You confirm each job, time and price with your customer.
It is not an emergency service. It tells anyone in danger to hang up and call 911. Urgent calls go to your cell by the rules you set, but we can't promise they reach you. Don't count on the Service in an emergency.
A person on our team listens to some of your calls, not all of them, to fix mistakes.
The AI runs on services from other companies. Our Privacy Policy names them. We may change them.
Text messages
We send texts in two programs:
- Maca account texts. Program name: Maca. From the Maca line, we text business owners who said yes to texts, about their site and account: setup, changes, daily call summaries, alerts about minutes, billing notices, and replies from their contact at Maca. Each text starts with “Maca:”.
- Texts for a business we answer for. Program name: that business's name. From the business's line, we text people who called it: one text back when a call was missed, a booking confirmation and reminders when the caller agreed to texts on the call, and, after a job, one request for a Google review and at most one follow-up. We also text the owner after each call we answer, and send urgent alerts, if the owner said yes. Each text to a caller starts with the business's name.
How many texts you get varies with calls and jobs. For example, the same number gets at most one missed-call text a day, and at most two review texts per job.
Msg and data rates may apply. Your phone company may charge you for texts you send and get. We don't charge for our texts.
Reply HELP for help. Reply STOP to stop. In Spanish, AYUDA gets help, and ALTO, PARAR or BAJA stop texts. When you reply STOP to any line we run, we stop texting that number from every line we run, for every business, right away. Reply START to get texts again.
Saying yes to texts is not a condition of buying anything. An owner who says no gets the same messages by email.
Carriers are not liable for delayed or undelivered messages. We can't promise every text arrives, or arrives on time.
Texts from a business's line start only after the phone companies approve that business's registration. That can take a few days or a few weeks. Until then, no texts go out from that line.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Our Privacy Policy says more, at getmaca.io/privacy#texts.
Texts that sell something, like texts to your past customers, are not part of these programs. They stay off until we turn them on for your business, under their own registration. Then they go only to people who agreed in writing to get texts from your business. You confirm that in writing, keep the proof, and give it to us when we ask.

Using Maca the right way
Use Maca only for honest, lawful work. You may not use it, or ask us, to:
- break any law, including the laws on calls, texts, email, recording, privacy, ads, prices, reviews and your trade;
- make sales calls, robocalls or recorded messages, or call lists of numbers (we answer the calls people make to you);
- make the AI say it is a person, or hide that it is AI or that the call is recorded;
- collect card numbers, bank numbers, Social Security numbers, passwords or health information from callers;
- text people who didn't call you, book with you, get your service or agree to your texts, or use bought, rented or borrowed lists;
- send texts about sex, hate, alcohol, guns, tobacco, cannabis, gambling, risky loans or debt collection, or anything else the phone companies ban;
- ask only happy customers for reviews, give anything in return for a review, write fake reviews, or hide honest ones;
- post false prices, deals, licenses, awards or claims, or photos of work that isn't yours;
- use photos, logos or words you don't have the right to use;
- threaten, harass or trick anyone, or pretend to be someone else;
- turn callers away because of race, color, religion, national origin, sex, disability, age or another trait the law protects;
- use bots or scrapers on our pages, test our systems for weak spots, or try to get in where you are not allowed;
- try to get the AI to reveal its instructions or other people's information;
- copy or resell the Service, or put someone else's number in a “Call me” form; or
- remove someone else's free site in bad faith.
If these rules are broken, we may refuse a request, remove content, stop texts or calls on a line, pause or end the Service, and tell a phone company, Google or the authorities where the law or their rules require it. When we can, we tell you first. Fines a provider charges us because of your breach are yours to pay.
Businesses we don't serve
Maca is built for local service trades. We don't serve:
- health care providers, or anyone whose calls would carry health information, because we are not set up to protect it the way health privacy law (HIPAA) requires;
- legal, tax or financial services, like law firms, tax preparers, lenders, credit repair, debt relief, debt collection, insurance sales, and investment or crypto offers;
- cannabis and CBD, tobacco and vaping, alcohol sales, guns and ammunition, and prescription drugs;
- gambling, sweepstakes, adult entertainment, and dating or escort services;
- services whose main job is emergencies, like alarm monitoring, medical alerts and crisis lines;
- bail bonds, payday loans, multi-level marketing and “make money” offers;
- political campaigns, fundraising, and charities asking for donations; and
- businesses outside the United States.
What's yours and what's ours
Your business name, logo, photos, words and customer lists, your web address, and your Google listing are yours. You let us use them, while you use the Service and for a short time after, only to provide the Service to you. You tell us you have the right to use what you send us, photos included.
Our templates, designs, code, tools, the AI's instructions and scripts, and the Maca name are ours. You may use them as part of your site while we host it.
Words, pages, posts and review replies we write only for your business become yours once published, as far as we hold rights in them. Our templates inside them stay ours.
Your site is yours to keep. If you leave and want to move it, we send you a copy of your site's pages, words and photos within 30 days of your ask, and you may keep using your site's design for your own business. Your free site also stays up with us.
We don't promise that a site meets a particular accessibility standard. If you or a customer finds a barrier on your site, tell us, and we fix what is in our control.
We never show your site, name, words or results in our marketing unless you say yes in writing, for example by text. You can take back your yes any time. We never use your callers' recordings, voices, names, numbers or words in our marketing.
If you send us ideas, we may use them and owe you nothing.
If you think something on a site we host uses your work without permission, write to hola@getmaca.io with the page and what it copies. We look into it and may take it down.
Your customers' information
When we answer calls and send texts for you, we handle your callers' and customers' information for you, as your service provider. We use it only to provide the Service to you: to answer, text, book, check our work, keep the Service safe, fix problems and follow the law. We don't sell it, share it for ads, or use it for our own marketing.
Companies that help us run the Service handle it for us under their own terms. Our Privacy Policy names them.
If a caller asks us to see or delete their information, we may send the request to you and help you answer it.
We protect it with reasonable safeguards. If a breach affects it, we tell you without undue delay.
Other companies' services
The Service depends on other companies: phone companies, Twilio, ElevenLabs, Google, Stripe, the company that registers web addresses, and our hosts. We are not responsible for what they do, for their outages or for their decisions, like a phone company blocking texts or Google suspending a listing. We work with you to fix what we can.
No promises about results
We work to help you get calls, jobs and reviews. We can't promise any number of calls, jobs, reviews or customers, or a spot on Google. Google, your customers and your market decide those. Math on our site, like what one job is worth, is an example, not a promise.
What we don't promise
Except for what these Terms say in words, we provide the Service “as is” and “as available.” As far as the law allows, we give no other warranties, spoken or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we don't promise the Service will work without breaks or mistakes.
Nothing our AI, our team or our content says is legal, tax, money, medical or other professional advice.
Limits on what we owe
As far as the law allows, neither of us owes the other for lost profits, lost jobs, lost revenue, lost data or lost goodwill, or for any indirect, special, incidental, consequential or punitive damages, even if told they could happen.
As far as the law allows, the most we owe you in total, for all claims about the Service or these Terms, is what you paid us for the Service in the 12 months before the event behind the claim. If you have paid us nothing, the most we owe is $100.
These limits don't apply to what you owe us, to your duties in “When a claim comes from your side,” or to anything the law doesn't let us limit. Some laws don't allow these limits. Where they don't, the limits apply as far as the law allows.
When a claim comes from your side
If someone makes a claim against us because of what you sent us or told us, the numbers you told us we could text or the consent you confirmed, your work, prices, estimates or promises to your customers, or your breach of these Terms or the law, you will defend us and pay the losses, fines, settlements and reasonable lawyers' fees that result.
We tell you about the claim soon, let you run the defense with a lawyer we reasonably accept, and help at your cost. You may not settle in a way that admits fault for us, or binds us, without our written OK.
When we can pause or end service
We may pause or end all or part of the Service, a free site included, if:
- a payment fails and isn't fixed;
- you break these Terms;
- your use could harm people or break the law;
- a phone company, Google, Stripe or another company we rely on requires it or stops serving us; or
- we stop offering the Service or a part of it.
When we can, we tell you first and give you a fair chance to fix the problem. We may act without notice when the law, a phone company or a provider requires it, or to stop harm.
If we end a paid package for one of the last two reasons, and not because of anything you did, we pay back the unused part of the time you paid for.
Law and disagreements
Colorado law governs these Terms, without its rules on which state's law applies.
If we disagree about something, write to us at hola@getmaca.io and tell us what's wrong. We will both try in good faith to fix it within 30 days. Neither of us will start a case before then, except to stop immediate harm or to protect our rights in names, designs or code.
If we can't fix it, any case goes only to the state courts in Boulder County, Colorado, or the federal court for the District of Colorado, and we both agree to those courts. Either of us may instead bring a case in small claims court where it qualifies.
Changes to these Terms
We may change these Terms. We post the new Terms here and change the date at the top.
If a change matters and is not in your favor, we tell you by email, and by text if you said yes to texts, at least 30 days before it starts. If you don't agree, you can cancel before it starts. If you paid for a year, you can instead get back the whole months you haven't used. If you keep using the Service after it starts, the new Terms apply.
Price changes follow the billing section.
Notices
We send notices to the email, and texts to the cell, you gave us for your account. Send notices to us at hola@getmaca.io. You can also cancel, or ask for your money back, by text or email to your contact at Maca.
Other terms
These Terms, with our pricing page, are the whole deal between us about the Service, and they replace earlier talks. “No contract” on our site means no long commitment: you can stop any month.
You may not pass these Terms to someone else without our written OK. We may pass them to a company that takes over the Service, and we will tell you.
If we don't enforce part of these Terms, we haven't given it up. If a part can't be enforced, the rest still applies, and that part applies as far as the law allows.
We are not responsible for delays or failures caused by things outside our reasonable control, like outages at phone companies or providers, internet failures, storms, fires, floods, power loss, strikes, government action or war.
We are independent of each other. Except for what you let us do for you in these Terms, neither of us is the other's agent, partner or employee.
These Terms give no rights to anyone else, including your callers and customers.
The parts of these Terms that by their nature should last, like money owed, what's yours and ours, your customers' information, what we don't promise, the limits, claims from your side, and disagreements, still apply after your package ends.
These Terms are in English and Spanish. If the two differ, the English version controls.
